School and Education Attorneys, James Kalny and Abby (Busler) Tilkens will be presenting at the 2022 WASB/WSAA School Law Conference & Workshop on Thursday, January 20, 2022 from 1:45 PM – 2:45 PM.
Their presentation, "Free Speech from the Tinker Era Through 2021 and Beyond" will explore the changing territory of free speech. After providing a brief update on legal considerations surrounding free speech for students and employees, including the recent U.S. Supreme Court decision in Mahanoy Area School District, Attorneys Kalny and Tilkens will discuss considerations within a free speech analysis, including interplay with technology, different forums in the school setting and out-of-school free speech and misconduct. Attorneys Kalny and Tilkens will address the latest cases addressing this issue and use practical hypotheticals to address various free speech situations. Finally, Ms. Tilkens and Mr. Kalny will provide practical tips for navigating staff, student and parent concerns regarding free speech.
