Overview

Amundsen Davis’s real estate team acted as counsel for a developer in the acquisition and development of a 234-lot residential subdivision that was part of a partially complete New Urbanist Development. The client desired to withdraw from the New Urbanist development and develop the property as a conventional development, which required consent from the city, the owner’s association and declarant who controlled the development. The opposition of residents was significant. Without being able to withdraw, however, the project could not proceed. We represented the client in all public hearings, drafted petitions, applications and development agreements and negotiated the terms of the agreements. We were able to obtain the necessary approvals to withdraw, rezone the property, subdivide the property and obtain satisfactory development agreements.
