Overview
The client faced a nationwide class action lawsuit alleging that it misrepresented the quality and condition of its products. At the outset, Amundsen Davis employed an aggressive strategy to dismiss the claims and strike the plaintiff’s class action allegations from the Complaint. As a result, the Court dismissed several claims, struck the nationwide class from the pleadings, and significantly narrowed the scope of the remaining state-wide class. After engaging in some discovery, the case resolved on an individual basis.
