Overview
Amundsen Davis defended a hospital and an individually named nurse in a medical negligence action which also named a non-employed physician. We obtained successful dismissal of the nurse and actual agency count for the physician on summary judgment. We also obtained successful motions in limine which minimized the case against the hospital on apparent agency and institutional negligence. The hospital was voluntarily dismissed just prior to jury selection.
