Overview
Amundsen Davis obtained a not guilty verdict before a jury in a construction jobsite injury case when the plaintiff, a pedestrian, fell into an uncovered open excavation and was injured. We argued that the condition was not inherently dangerous and that if it was, it was open and obvious. The clients, a private underground contractor and a municipal entity, were found not liable on all counts after the jury deliberated for only a few hours.
