Represented lawyers and their law firm before multiple jurisdictions including the Circuit Court of Cook County and the Northern District of Indiana, and corresponding bankruptcy court proceedings. At issue was the attorneys’ involvement as a director/officer of the company and the firm’s capacity as outside counsel prior to the company’s bankruptcy. Our team obtained dismissal of many of the circuit court claims which was sustained on appeal before the First District of Illinois. Ken also defended a number of director/officer claims against the attorneys that eventually settled while yet another motion to dismiss was pending.
