Overview

Amundsen Davis received dismissal of a matter brought by parents of a minor tenant (apartment complex) who was involved in a sexual relationship with one of the staff landscapers. The allegations centered on the apartment building’s failure to conduct a background check on the landscaper and failure to secure common areas, like the laundry room, where certain sexual encounters allegedly took place. Ultimately, it was discovered that the landscaper had no criminal background. Consequently, the plaintiff asserted that because of the landscaper’s cultural background, the defendant should have known it was foreseeable that he could engage a relationship with a young tenant and therefore should have been supervised more closely.
