Overview
Amundsen Davis represented our client in a property dispute lawsuit between neighbors. The plaintiff initiated the lawsuit seeking to narrowly define the dimensions of the access easement over their property to our client’s property and alleged trespass and nuisance claims. We fought back with counterclaims for adverse possession, prescriptive use rights, trespass, and nuisance.
The court held a three-day bench trial and ruled in our client’s favor. The judge rejected the plaintiff’s claims entirely, found that our client has prescriptive rights over a large portion of the plaintiff’s property, found the plaintiff liable for trespass and nuisance, and awarded our client compensatory and punitive damages.
This case shows that persistence and strategic legal representation can make a big difference in resolving complex property disputes.
