Overview

Amundsen Davis successfully defended truck owners who leased their truck to a driver who was then involved in an accident. The plaintiff was an occupant of a motor vehicle that was involved in an accident with our client’s company truck. We represented the owners of the vehicle who was the lessor of the truck, the company who was the lessee the truck, and the driver of the truck. We filed and won a motion to dismiss the counts against the owner of the truck, arguing that under the Graves Amendment, an owner of a motor vehicle that leases the vehicle to another entity is not liable for harm resulting from the lessee’s use of the vehicle when there was no negligence on the part of the owner. The owner was dismissed from the case with prejudice.
