Amundsen Davis won a motion to dismiss in a common law retaliatory discharge case under the Workers’ Compensation Act after arguing that the complaint failed to state a claim entitling the plaintiff to recover because the plaintiff was never discharged from her job. The court found that the plaintiff failed to show she was terminated from her position. The dismissal was upheld in the 4thDistrict Appellate Court.
