Overview

A plaintiff filed a lawsuit against a large transportation client for wrongful possession of her personal items. Audrey successfully orally argued and obtained summary judgment on behalf of the client in this detinue case. The personal items originally included just a suitcase, but eventually became in excess of $30,000 of claimed missing items (jewelry, clothing, identification, important papers, and cash). The plaintiff was unable to meet any of the elements of her cause of action, such as failure to show wrongful possession vs. merely lost or misplaced items, and unable to show the value or ownership of the items. This was attacked during oral argument and the case was dismissed with prejudice on behalf of the transportation client.
