In Uesco Industries v. Poolman of WIsconsin, a broadcaster had faxed an advertisement to the plaintiff, contrary to the defendant’s express instruction to limit said broadcast to specific companies. For the first time in court, the Illinois Appellate Court agreed with Amundsen Davis’s argument that the defendant was not liable for the acts of a third party.
