Assisted Clients With an FDA Investigation and Voluntary Recall of a Food Additive Product

Overview

Acted as coordinating counsel defending our clients in connection with an FDA investigation and voluntary recall of a food additive product. The product was alleged to have been contaminated with a bacterial organism that caused multiple injuries and deaths of premature infants who consumed the product which was processed (manufactured) by our client. The firm worked with outside counsel to coordinate the company’s response to a series of tort suits filed by the parties allegedly damaged by consumption of the food product.

In connection the firm acted as lead trial counsel in suits pending in multiple jurisdictions and supervised the work of local counsel in matters pending in the state and U.S. Dist. Courts in the following jurisdictions: NY; VA; NC; MO; FL, GA & TX as well as in Illinois. 

The firm has also acted in consultation with the client’s outside counsel in connection with the FDA regulatory proceedings stemming from the investigation and recall and with outside general counsel in connection with the defense of commercial litigation filed by in Missouri.
