Overview

Successfully obtained summary judgment on behalf of a solar financing business in an Illinois Prevailing Wage Act enforcement action. The Illinois Department of Labor (IDOL) sought to impose prevailing wage liability through novel alter ego and joint employer theories against our client, despite neither entity having an employment relationship with the actual workers or qualifying as a contractor or subcontractor under the Act. The court granted summary judgment on all grounds advanced by a very exhaustive and thorough defense.
