Defended Manufacturer Against Attempt to Unionize Laborers

Overview

Our labor team was retained to defend a manufacturer against an attempt by the Laborers to organize the plant employees at the company’s facility in Kankakee, Illinois.  This was the second attempt since 2013 by the Laborers to organize the plant employees. The campaign posed novel issues because, not only was this was a second campaign in a short timeframe, but the company’s nearby affiliate was in the midst of contract negotiations with this same union.  Also, during the campaign, the Union filed a series of unfair labor practice charges against the company. We forged a campaign that not only addressed employee concerns at the company’s facility, but that also countered the union’s campaign that focused on gains it allegedly had achieved at the affiliate.  The end result was an election defeat for the Union, and favorable disposition of the unfair labor practice charges.  The results of the election were certified by the National Labor Relations Board in April of that year.
