Michael Barnes obtained summary judgment for a hardware store in a premises liability action where the plaintiff allegedly tripped and fell over a folded mat in the store, but nobody witnessed the fall and the plaintiff himself did not see the alleged fold before tripping. The court agreed that the plaintiff could not adequately identify the cause of his fall to establish proximate cause and entered summary judgment for the defendant.
