Darren Grady and the Amundsen Davis team obtained summary judgment on behalf of a national beverage corporation in a personal injury matter where the plaintiff tripped on an exposed pallet under a display at a grocery store allegedly containing the defendant’s products. The plaintiff was seeking six figures in damages after fracturing her hip. After hearing the argument the judge agreed that the exposed pallet was an open and obvious condition and that if the plaintiff was distracted, the defendant did nothing to cause or contribute to the distraction.
