Secured Dismissal of Strict Liability Claims in Catastrophic Construction Incident Litigation

Obtained dismissal of plaintiffs’ strict liability claims in two consolidated matters stemming from a catastrophic construction/premises incident. The court granted motions to dismiss after finding that the certifying defendant satisfied the requirements of the applicable Distributor’s Statute in moving for dismissal, significantly narrowing the claims at issue and reducing potential exposure.
