Successfully Defended Suit and Obtained an Order Dismissing it with Prejudice in the Representation of a Chicago Bank

Amundsen Davis successfully defended suit and obtained an order dismissing it with prejudice in the representation of a Chicago bank that had a mortgage on a customer’s residence. The bank was named as a defendant in a lawsuit that was filed by individuals that had previously contracted to purchase the residence, but who cancelled the contract due to their inability to obtain financing. The former purchasers sued claiming that their contract was superior to the bank’s mortgage and sought to terminate the mortgage and force the property be sold to them.
