Michael Cortina weighs the true cost of using arbitration and mediation clauses to quickly resolve legal disputes in the article "Time is Money," published in the May 2026 edition of ISBA's Bench and Bar newsletter.
He states, "Arbitration and mediation clauses can be very helpful and can certainly aid in having disputes resolved quickly. Sometimes, however, speed and efficiency may not be worth the cost."
